eLearning Patent Awarded to Blackboard Inc. Draws Ire of Competitors, Schools

Learning management systems (LMS) provider Blackboard Inc. has sued a smaller business rival over a patent it was issued in January covering its LMS technology. The patent, and subsequent lawsuit, have significant implications for the future of eLearning at colleges and universities nationwide. Critics say Blackboard's patent is overly broad and could stifle innovation in the eLearning industry.
August 29, 2006—A full-fledged flap has developed in the eLearning community over a U.S. patent awarded last January--but announced only last month--to Blackboard Inc., the market leader in learning management system (LMS) applications.
Blackboard's patent reportedly covers certain systems and methods involved in offering online education, including course management and enterprise eLearning systems. Corresponding patents, Blackboard says, have been issued in New Zealand, Singapore, and Australia. The company also reports that similar patents are pending in Canada, the European Union, China, Japan, Israel, Brazil, India, Mexico, South Korea, and Hong Kong. The Surdna Foundation announces the seventh year of a national initiative to support the artistic revitalization of outstanding arts teachers in specialized, public arts high schools. Surdna recognizes that arts teachers often lack the time and resources to reconnect with other arts professionals and with the artistic processes they teach. Through the program, fellows will design individualized courses of study that will provide both immersion in their own creative work and the opportunity to interact with other professional artists in their fields. Surdna believes that this approach to professional development will enhance the effectiveness of arts teachers and will directly benefit the young people they teach. All fellowsaccompanied by school leaderswill convene in fall 2007 to share experiences and discuss relevant issues and concerns. (Convocation expenses will be paid by Surdna.) Fellows will also be expected to work with colleagues and school administrators to carry out post-fellowship plans, and submit a report on the impact of the fellowship.

The goal of this initiative is to design and implement appropriate and creative service projects that engage such youth in service and develop their capacity for leadership and civic engagement. A significant component of the service should occur on National Youth Service Day, April 20-22, 2007.

Applications will be available online beginning in September. In the face of budget shortages, field trips are often one of the first elements eliminated from the curriculum. Target hopes that teachers can use this grant to continue using the valuable experiential learning gained from field trips to enhance students' classroom studies. As a cornerstone of the giving program, Target educational programs focus on teachers and classrooms, and early childhood reading. Target also supports schools and educational organizations through local grant donations.

In the past decade, $1.4 million has been awarded to more than 125 schools in 40 U.S. states/territories. In 2004, the awards program was expanded to include community groups who are protecting planet Earth.

Temporary Staffing and Telecom Cost Management Analysis’ from The Aberdeen Group
Temporary Staffing/Contingent Labor/Contract Labor
According to a new study by Aberdeen Group, The Contract Labor Cost Management Benchmark Report, over 50% of the benchmark survey indicated they plan to increase their temporary staffing budget and 12% plan greater than 10% growth. This continues a trend, over the past few years, of strong global demand for temporary workers particularly in the IT department, which ranks as the top temporary staffing job category. It also reflects the tight labor market for full-time employees in the U.S., where Bureau of Labor Statistics data shows IT staffing is now above the 2001 peak. The international temporary staffing market is also very strong with the largest staffing companies deriving most of their revenues outside of North America. A few years ago countries like Italy prohibited temporary staffing arrangements and other countries had ambiguous laws that made it risky for enterprises to pursue temporary staffing. While some countries continue to have laws that require six weeks of unemployment pay after a temporary staffing assignment has been completed, most countries realize they need contingent labor in an international market to compete in a global labor market. They also are seeking to attract international companies to locate operations in their country by ensuring exports are competitive.
Aberdeen Group found that 59% of the temporary positions fill highly-skilled technical positions and 31% work in lower-skilled positions.
Organizations cited the following top benefits for their contract labor programs:
- Flexibility to add and reduce workforce
- Ability to hire specialized skills
- Capability to perform project oriented functions
- Capacity to meet varying workload and seasonal demand
- Lower risk through “trial before hiring.”
It should be noted that 83% of the benchmark report that they hire a number of these temporary staffers as full-time employees.

IP Telephony: the VNO Perspective

Is Your Institution an "Interconnected VoIP Service Provider"?
As the upcoming fall semester approaches, many colleges and universities are moving forward with the planning, development, and deployment of VoIP solutions on campus. This Alert provides a regulatory backdrop to assist in your planning and decision-making process by providing greater detail on the potential regulatory issues associated with the deployment of VoIP products.
Given the differences amongst institutions - as well as the significant legal ambiguity - no hard and fast pronouncements can be made. Nevertheless, this Alert endeavors to provide greater clarity as to the scope of current federal requirements. Accordingly, an independent assessment of whether the requirements described herein apply should be made for each institution. In this regard, we recommend contacting legal counsel prior to the wide deployment of VoIP services on campus, particularly for any services provided to entities beyond the campus community or for a fee.
To date, the Federal Communications Commission (FCC) has issued three decisions with respect to a specific subset of VoIP services -interconnected VoIP service providers.
- E911. In June 2005, the Commission required interconnected VoIP providers to transmit 911 calls, as well as a call back number and the caller's registered location for each call, to the public safety answering point (PSAP) or other designated answering point. More detail can be found at http://hraunfoss.fcc.gov/edocs_public/attachmatch/FCC-05-116A1.pdf- CALEA. In September 2005, the Commission required interconnected VoIP providers and facilities-based providers of broadband Internet access to comply with the law enforcement access provisions of CALEA. As you may recall, the recent judicial case focused on the facilities-based broadband provider requirements (e.g., whether private university networks had to comply). In June 2006, the Commission required interconnected VoIP providers to contribute to the universal service fund for the first time. Interconnected VoIP services are generally defined as those services that meet the following four criteria:
(1) Enable "real-time, two-way voice communications";
(2) Require "a broadband connection from the user's location";
(3) Require "IP-compatible CPE"; and
(4) Permit "users generally to receive calls that originate on the PSTN [public switched telephone network] and to terminate calls to the PSTN." With respect to this last requirement, the Commission has explained that only the capability for users to receive/terminate calls to the PSTN is necessary to meet the definition. Thus, a service may be classified as an interconnected VoIP service even if no PSTN-based communications actually occurs.
